1. Who we are
The Starpha platform is operated by Ido Lavon, of Haifa, Israel ("we", "Starpha"). Contact: ido@ereris.com.
2. What the platform does
Starpha connects student crews who design and manufacture physical products with local businesses that display and sell them at the counter. It also runs a collecting layer: every product has a collectible card, and users collect cards by physically visiting the business and scanning there.
3. Who may use it
Use is permitted from age 18. A user under 18 may use the platform only after a parent or guardian has signed the separate consent form. We may require age verification and suspend an account opened in breach of this clause.
4. Account
Details you give must be true and current. The account is personal and non-transferable. You are responsible for your access credentials. Tell us immediately about unauthorised use.
5. Location
To earn a card you must be physically at the business. At the moment of scanning only, the app requests the device location and compares it with the business location within roughly 300 metres. There is no continuous location tracking, and declining the location permission does not prevent use of the rest of the platform. Full detail in the Privacy Policy.
6. Coins
The platform includes internal coins. Coins cannot be bought with money. They are earned through activity only, have no monetary value, cannot be exchanged for money, transferred or redeemed, and are not a means of payment. We may change how they are earned and spent, with prior notice.
7. Collectible cards
A card is a digital collectible, and in some cases also a printed item accompanying a product. A card is never redeemable for money, is not a security, is not a financial asset, and confers no interest in the business or its profits. We may cancel a card obtained by deception, including location spoofing.
8. Purchases
Products are sold at the business displaying them. Sale, delivery, cancellation and return terms are set out in the "Sale, Delivery and Returns" document, which forms part of these terms.
9. Content you upload
You are responsible for what you upload and confirm you hold the rights to it. Do not upload content infringing anyone's rights, including protected designs, logos or characters. We may remove content that appears infringing and suspend a repeat account.
10. Prohibited use
Do not spoof location, automate the accumulation of cards or coins, compromise system security, or use the platform for any unlawful purpose.
11. Liability
The platform is provided as is. We are not liable for indirect or consequential loss. Our total liability to a user will not exceed the amount actually paid by them in the three months before the event. Nothing here derogates from rights that cannot be contracted out of by law.
12. Termination
You may close your account at any time. We may suspend or close an account for breach of these terms, and will in that case transfer accrued sums due to you as required by law.
13. Changes
We will give prior notice of a material change. Continued use after the effective date is acceptance.
14. Law and jurisdiction
Israeli law applies. Exclusive jurisdiction lies with the competent courts of [Haifa].

2. מה הפלטפורמה עושה
סטארפה מחברת בין צוותי סטודנטים שמעצבים ומייצרים מוצרים פיזיים לבין בתי עסק מקומיים שמציגים ומוכרים אותם על הדלפק. בנוסף, הפלטפורמה מפעילה שכבת איסוף: לכל מוצר יש כרטיס אספנות, ומשתמשים אוספים כרטיסים על ידי הגעה פיזית לבית העסק וסריקה במקום.
3. מי יכול להשתמש
השימוש מותר מגיל 18 ומעלה. משתמש מתחת לגיל 18 רשאי להשתמש בפלטפורמה רק לאחר שהורה או אפוטרופוס חתם על טופס ההסכמה הנפרד. אנחנו רשאים לדרוש אימות גיל ולהשעות חשבון שנפתח בניגוד לסעיף זה.
4. חשבון
הפרטים שתמסרו צריכים להיות נכונים ומעודכנים. החשבון אישי ואינו ניתן להעברה. אתם אחראים לשמירת פרטי הגישה. הודיעו לנו מיד על שימוש לא מורשה.
5. מיקום
כדי לזכות בכרטיס יש להיות פיזית בבית העסק. בעת הסריקה בלבד, האפליקציה מבקשת את מיקום המכשיר ומשווה אותו למיקום בית העסק ברדיוס של כ‑300 מטר. אין מעקב מיקום רציף, ואי‑מתן הרשאת מיקום אינו מונע שימוש בשאר הפלטפורמה. פירוט מלא במדיניות הפרטיות.
6. מטבעות
הפלטפורמה כוללת מטבעות פנימיים. לא ניתן לרכוש מטבעות בכסף. המטבעות מושגים בפעילות בלבד, אין להם ערך כספי, אינם ניתנים להמרה לכסף, להעברה או לפדיון, ואינם אמצעי תשלום. אנחנו רשאים לשנות את כללי הצבירה וההוצאה בהודעה מראש.
7. כרטיסי אספנות
כרטיס הוא פריט אספנות דיגיטלי, ובחלק מהמקרים גם פריט מודפס המצורף למוצר. כרטיס אינו ניתן לפדיון בכסף, אינו נייר ערך, אינו נכס פיננסי ואינו מקנה זכות בחברה או ברווחיה. אנחנו רשאים לבטל כרטיס שהושג בדרכי רמייה, לרבות זיוף מיקום.
8. רכישות
מכירת מוצרים מתבצעת בבית העסק שבו המוצר מוצג. תנאי המכירה, האספקה, הביטול וההחזרה מפורטים במסמך "תנאי מכירה, אספקה והחזרות" המהווה חלק בלתי נפרד מתנאים אלה.
9. תוכן שאתם מעלים
אתם אחראים לתוכן שאתם מעלים ומצהירים שיש לכם את הזכויות בו. אין להעלות תוכן שמפר זכויות של אחר, לרבות עיצובים, לוגואים או דמויות מוגנות. אנחנו רשאים להסיר תוכן שנראה לנו מפר, ולהשעות חשבון חוזר.
10. שימושים אסורים
אין לזייף מיקום, להפעיל אוטומציה כדי לצבור כרטיסים או מטבעות, לפגוע באבטחת המערכת, או להשתמש בפלטפורמה למטרה בלתי חוקית.
11. אחריות
הפלטפורמה ניתנת כמות שהיא. איננו אחראים לנזק עקיף או תוצאתי. אחריותנו הכוללת כלפי משתמש לא תעלה על הסכום ששילם בפועל בשלושת החודשים שקדמו לאירוע. אין באמור כדי לגרוע מזכויות שאינן ניתנות להתניה על פי דין.
12. סיום
אתם רשאים לסגור חשבון בכל עת. אנחנו רשאים להשעות או לסגור חשבון בהפרה של תנאים אלה, ובמקרה כזה נעביר תשלומים שהצטברו ומגיעים לכם בהתאם לדין.
13. שינויים
נודיע על שינוי מהותי מראש. המשך שימוש לאחר מועד הכניסה לתוקף מהווה הסכמה.
14. דין ושיפוט
על תנאים אלה חל הדין הישראלי. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים ב[חיפה].
